Terms of Service

Welcome to Stockd (“Stockd,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of stockdsale.com (the “Site”) and the marketplace services offered through it (together, the “Services”). By using the Services you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using the Services you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@stockdsale.com if you suspect unauthorized use.

3. The marketplace

Stockd is a marketplace for digital goods. Sellers list and sell digital products; buyers purchase those products. Unless explicitly stated, Stockd is not the seller of items listed by independent sellers.

4. Permitted listings

The marketplace supports legitimate digital products only, including:

  • Creator-made templates, prompts, plugins, themes, ebooks, courses, AI workflows, design kits, and code packs.
  • Vendor-authorized software licenses, lifetime deals, and SaaS resale where the rights-holder explicitly permits resale.
  • Digital services and custom work.

5. Prohibited listings

You may not list or sell, and we will remove and may permanently ban accounts that attempt to list:

  • Stolen, hacked, or fraudulently obtained accounts of any kind.
  • Shared subscription seats sold to non-household users.
  • Cracked, pirated, or otherwise unauthorized software.
  • Unauthorized API tokens, credentials, or access methods to third-party services.
  • Account farming or boosting services that violate the host platform’s terms.
  • Items that violate applicable law, the platform of origin’s terms of service, or third-party intellectual property rights.

6. Buyer protection (free, by default)

Every purchase on Stockd is covered by free buyer protection. Funds are held in escrow until the buyer confirms delivery or an automatic release window passes. Buyers may open disputes within 14 days of delivery. See our Refund & Buyer Protection Policy for full terms.

7. Fees

Buyers pay listed prices plus any applicable taxes and payment processor fees. Sellers pay a commission on each sale (10% default, 7% on Pro plan), plus pass-through payment processor fees. Subscription fees apply to optional seller plans. We do not mark up payment processing.

8. Payments and payouts

Payments are processed by third-party providers (Stripe, PayPal, NowPayments). Payouts to sellers are made via Stripe Connect, PayPal, or supported crypto rails after a hold period. Payouts may be delayed pending dispute resolution or risk review.

9. Taxes

Sellers are responsible for determining and collecting any applicable taxes on their sales, except where Stockd is required by law to collect on the seller’s behalf (e.g., certain VAT/GST regimes).

10. User content

You retain ownership of content you submit. You grant Stockd a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Services.

11. Intellectual property

You may not list content that infringes third-party rights. We respond to valid takedown notices in line with applicable law (DMCA in the United States and equivalent regimes elsewhere). See our DMCA / IP Policy.

12. Acceptable use

You agree not to: misuse the Services, attempt to gain unauthorized access, scrape or copy our database, send spam, harass other users, manipulate ratings or reviews, or abuse referral, affiliate, or coupon mechanics.

13. Termination

We may suspend or terminate accounts that violate these Terms, with or without notice in cases of fraud, abuse, or risk to other users.

14. Disclaimers

The Services are provided “as is” and “as available.” To the maximum extent permitted by law, Stockd disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

15. Limitation of liability

To the maximum extent permitted by law, Stockd will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, revenue, or data, arising from use of the Services. Our aggregate liability for any claim shall not exceed the greater of (a) the amount you paid Stockd in the 12 months before the claim, or (b) USD $100.

16. Indemnification

You agree to indemnify and hold Stockd harmless from any claim arising from your breach of these Terms, your content, or your misuse of the Services.

17. Governing law

These Terms are governed by the laws of the jurisdiction in which Stockd is established, without regard to conflict-of-law principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection law provides otherwise.

18. Changes

We may update these Terms. Material changes will be announced on the Site. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
